Self-Represented vs Lawyer-Led CTP Claims: What Queensland Drivers Need to Know

If you’ve been injured in a car accident in Queensland and you’re not at fault, you’re entitled to lodge a Compulsory Third Party (CTP) insurance claim.

But one of the most important decisions you’ll make is whether to handle the claim yourself or get a personal injury lawyer involved.

The end result is that when you make a claim yourself through the insurer you will end up with less in your hand then what a personal injury lawyer will be able to achieve for you and that is even after paying legal fees.

The insurers bottom line is their profits, and our bottom line is that we are paid to get you the money you deserve.

We’ve seen first hand the immense difference in what an insurer is willing to offer an individual vs. what we have been able to achieve.

We have read all the reports put out by the MAIC on the subject, and we will continue to advocate to everyone to not sell themselves short so that they can get the compensation they deserve.

What’s Covered by CTP Insurance?

CTP insurance is mandatory in Queensland and is designed to cover people who are injured in road accidents.

If you’re not at fault, it can pay for your :

  • Pain and suffering
  • Medical treatment
  • Superannuation
  • Gratuitous and paid care
  • Past and future Economic Loss

But here’s where it gets tricky, if you go directly to the insurance company they will only assess and pay for the most obvious and immediate costs.

They do not automatically include compensation for lost income, loss of future earning capacity, or superannuation unless it is evidenced and claimed for.

Sometimes, we need to go to court when we are standing our ground for our clients entitlements! This is where legal expertise becomes critical.

Key Differences : Going It Alone vs Having a Lawyer

1. Compensation Amounts

The most glaring difference is in the amount of compensation people receive.

According to data referenced by industry publications:

  • Self-represented claimants receive, on average, around $13,000.
  • Legally represented claimants receive closer to $99,000.

(Source: Fresh PRM, “Injured Queensland Drivers Are Being Short-Changed in Compensation and Care”)

That’s a massive gap—and it’s not because the injuries are different. It’s because lawyers understand the full scope of damages you’re entitled to claim.

2. Medical Treatment and Rehab Support

People who go it alone also receive less insurer-funded medical care and rehab on average, 3.17 times less than those with legal representation.

Why?

Because many self-represented claimants don’t know they can ask for additional treatments—or how to negotiate with insurers.

3. Loss of Wages and Super

One of the most overlooked parts of a self-managed claim is economic loss:

  • Lost income from time off work
  • Loss of future earning ability (especially if you’re forced into a lower-paying job or early retirement)
  • Lost superannuation contributions

Lawyers know how to calculate these losses accurately and include them in your claim. CTP insurers will not volunteer this information.

4. Timeframes and Pressure to Settle

Self-represented claims often settle quicker, but that’s not always a good thing. Insurers may pressure injured people to accept early settlements before they understand the full extent of their injuries.

A lawyer ensures your claim isn’t finalised until your condition has stabilised and all damages are accounted for.

Why the Difference?

It’s not just about legal jargon, it’s about knowing what to ask for.

CTP insurers are businesses. They’re not obligated to explain every benefit you might be entitled to.

Without legal representation, you may never even realise how much money and support you’re missing out on.

A personal injury solicitor will :

  • Investigate the accident thoroughly
  • Gather medical evidence
  • Accurately calculate lost income and future losses
  • Negotiate hard with insurers to get you fair compensation

In Queensland, personal injury lawyers operate under strict fee rules, including the “50/50 rule”, which limits how much of your settlement can be used for legal costs.

Most reputable firms—including Revolution Law—charge far below this cap.

Even after legal fees, clients almost always walk away with significantly more compensation than if they’d gone it alone.
